The Talmud is a central text of Rabbinic Judaism. It is also traditionally referred to as Shas (ש״ס), a Hebrew abbreviation of shisha sedarim, the “six orders”, a reference to the six orders of the Mishnah. The term “Talmud” normally refers to the collection of writings named specifically the Babylonian Talmud (Talmud Bavli), although there is also an earlier collection known as the Jerusalem Talmud, or Palestinian Talmud (Talmud Yerushalmi). When referring to post-biblical periods, namely those of the creation of the Talmud, the Talmudic academies and the Babylonian exilarchate, Jewish sources use the term “Babylonia” from a strictly Jewish point of view, still using this name after it had become obsolete in geopolitical terms.

Bava Metzia is the second of the first three Talmudic tractates in the order of Nezikin (“Damages”), the other two being Bava Kamma and Bava Batra. Originally all three formed a single tractate called Nezikin (torts or injuries), each Bava being a Part or subdivision. Bava Metzia discusses civil matters such as property law and usury. It also examines one’s obligations to guard lost property that have been found, or property explicitly entrusted to him.

Перевод сопровождается краткими комментариями, опирающимися на комментарии крупнейшего средневекового ученого-талмудиста Раши. В дальнейшем планируется выпустить в свет перевод всех трактатов Талмуда.
Главная тема трактата Бава-Мециа, который в нашем издании представлен шестью томами, – законы Торы и мудрецов, связанные с выяснением статуса спорного имущества. В первом томе из шести приведен перевод первой главы трактата. Она посвящена законам установления права собственности на находку. Отдельно рассмотрены способы приобретения найденных вещей, не подлежащих возврату бывшим владельцам. Подробно исследуется казус потерянных документов: долговых расписок, обязательств, разводных писем и пр. Большинство ситуаций, рассматриваемых Талмудом в этой главе, вполне актуальны и для нашего времени.
